and Purchaser Agreement
Copier1 may
choose to cover additional elements or situations
involving a customer's machine beyond those warranties contained below.

THIS
WARRANTY IS APPLICABLE FOR ALL CUSTOMERS OF EQUIPMENT
PURCHASED FROM COPIER1, LLC FOR BUSINESS AND PERSONAL USAGE EXCLUDING
COMMERCIAL PRODUCTION ACCOUNTS OR WHERE OTHERWISE DESCRIBED HEREIN.
1. Five
year (minimum) major component guarantee on all copiers
excluding production, engineering, and wide format equipment. Five
year free
replacement guarantee on all used, refurbished, and remanufactured copiers
covered herein. Copier1 warrantees the main unit
to be free from major malfunction for a period of 5 years from date of
purchase. This includes all touch screens, push button and numeric
control panels, lasers, ALL circuit boards, ALL motors including main
drive motor, main
logic and all other circuit boards including finisher, document feeder and any other boards contained
within the main copier unit, including
interfaces and other related accessories. Copier1 will also warranty
major gear/drive packs in a similar manner under most conditions. Copier1 will ship
replacement components within 48 hours free of charge, excluding
shipping and handling. Under conditions where copier is deemed
by Copier1 to be
irreparable, Copier1 will replace the machine with a
similar copier of the same or newer production series, or a newer
machine if that copier is no longer available or practical, at the discretion of Copier1 at no charge to
customer other than shipping. Installation costs of warranted
components is the responsibility of Customer. For machines in operation beyond 5 years
from date of purchase, Copier1 will provide major component replacement
guarantee for the useful life of the machine, up to 7 years from
original sale date.
2.
30 Day 100% Parts
Warranty for black and white and color remanufactured, refurbished,
used, and
demonstrator copiers.
Copier1 guarantees all parts within copier to be free from defects for a
period of 30 days from date of delivery. All parts
covered under warranty are to be supplied by copier1 or approved for
purchase by third party vendor. Unless agreed
to by Copier1 management before installation, all repair parts will be
provided by Copier1. Any required
machine installation labor is not included- including
computer and network installation. Customer will be provided equipment documentation,
CD/Drivers and/or download instructions, and Help Desk
installation support at no charge. For
the remaining period of the limited warranty, we will replace any
defective part with new or refurbished parts, upon confirmation of need
for replacement. If you purchase an additional maintenance
agreement, service will be provided to you under the terms of the
maintenance agreement, if your contract is with Copier1. Please refer to
that contract for details on how to obtain service. If you purchased
through us a service contract with one of our third-party service
providers, please refer to that contract for details on how to obtain
service.
3. Help Desk.
Customers of all copiers supported by Copier1.com Help Desk technical
support shall be entitled to use of said technical support, free of
charge for 1 year from date of purchase.
4. Drum warranty.
Black and white copiers remanufactured by Copier1 come with a 6 month,
30,000 maximum copy drum (photoreceptor) warranty. This warranty is in
effect up until 30,000 copies or the number of copies rated for the
photoreceptor by the copier manufacturer, whichever is lower. Under
circumstances where drum fails within this period, Copier1 will provide a
replacement drum free of charge, with shipping and handling costs to be
paid by customer.
5. Copier1 guarantees
that unless otherwise stated, all copiers will be operable or made
operable upon receipt by customer. Most copiers install without
incident, and are operable within minutes. First resort under
circumstances where copier arrives inoperable due to shipping conditions
are for customer to contact Copier1.com Help Desk for technical support.
Copier1 management will provide customer with technician upon request.
Any repairs to be paid for by Copier1 must be pre-approved by Copier1
management BEFORE repairs are performed. Copier1 will assist with shipping claims and, in most cases,
supply all damaged parts without cost in advance of any claims being
paid. We
use new and refurbished parts made by various manufacturers in
performing warranty repairs and in building replacement parts and
systems. All parts and systems are inspected and tested for quality.
Replacement parts and systems are covered for the remaining period of
the limited warranty for the product you bought. Copier 1COPIER1 owns
all parts removed from repaired products. Customer hereby agrees that
Copier1 representative or contractee will be allowed into customer
premises during normal business hours to provide any warranty or
non-warranty repair to equipment purchased from Copier1.
6. Copier1 will replace or exchange equipment found to not be feasibly
repairable under warranty. Customers may request and expect replacement
for copiers which do not function to
manufacturers specification. Customer must allow repair attempts prior to replacement authorization. Remember, your copier was just
transported, and the most common time for the machine to need fine
tuning or installation labor is after shipment. If Copier1 is unable to
complete installation to reasonable operation and on-site technician
confirms in writing that the machine is inoperable, Copier1 will issue a
Replacement Authorization. If customer returns,
rejects or cancels shipment anytime subsequent to placing order customer agrees to pay all shipping and restocking
fees, and to deduct from any refunds for any service, delivery, and installation charges
incurred at the standard billable rate.
Copier1 will, when return has been approved, arrange for return shipping
at our corporate discount rates with usual shipping agent or agent of
customers choosing so long as said shipper provides air ride, padded
transportation. Customer will receive full refund for all equipment,
accessories, and supplies, including unused toner in original packaging
less any applicable and aforementioned fees. Credit card
processing fees of no more than 3% are the responsibility of the
customer and are to be subtracted from refund.
Equipment return requests must be made in writing to Copier1, LLC at
2020 Windsor Drive Unit A1, Salisbury Maryland, 21801 within
20
days of original order date. All usage on returned equipment
may result in refund adjustment at market per-click rental rates.
7. This warranty does
not cover service necessitated by malfunctions of parts and/or
attachments and/or supplies sold, provided, or installed (excluding the
installation of supplies) by anyone other than Copier1, or by use of
paper not compatible with the equipment. Customer may purchase toner and
supplies from other vendors, but there is a small possibility that
portions of warranty related to use of said supplies may be voided, if
damage is due to faulty toner, developer, photoreceptor (drum) or other
consumable, or from parts not
purchased from Copier1.
8.
Under no circumstances shall payment of invoices or acceptance of
equipment be contingent upon networking services being provided on-site
by Copier1, LLC. Customer may contract or Copier1, LLC may suggest or
assist in obtaining the services of on-site networking firms or
individuals in situations where Customer staff in unable to achieve
software integration or in situations where customer is not technically
able to accomplish installation of all desired networking features. All
necessary print and scan drivers are easily available through the World
Wide Web, vendor, manufacturer, and third party websites in situations
where Copier1 is, for any reason, unable to deliver such drivers to
customer, and such software downloading and integration is not the
responsibility of Copier1 to install or make active.
9. Specification
changes, alterations or attachments may requires a change in the
warranty set forth herein. Such changes shall become effective upon
notice to Customer by Copier1. Copier1 also reserves the right to
terminate this Agreement by notice to Customer if Copier1 determines
that such changes, alterations or attachments make it impractical for
Copier1 continue to warrantee the equipment. This Agreement
shall not apply to any equipment which ceases to be at the original
Customer shipping destination location or is damaged through accident,
abuse, misuse, theft, neglect, acts of third parties, fire, water, war,
casualty or an other natural force.
10. Copier1 shall have
right to consequential damages by any reason of non-performance of this
agreement. Customer agrees to resolve any disputes regarding credit card
charges through legal means other than Credit Card company or issuing
bank. That is, such disputes are to be resolved through legal channels
or agreed upon terms. Copier1 shall be entitled to consequential
damages, including but not limited to attorneys' fees, arising out of
customer's non-performance of this purchase agreement.
11. Copier1 management
may, upon agreement and acceptance by Customer, elect to replace the covered equipment with
comparable equipment in order to provide required reliability for
customer. Customer may incur costs associated with equipment replacement
during the term of this warrantee, and agrees to pay any necessary
transportation costs.
12. Customer accepts the fact that due to the complicated
nature of the photocopying process, copiers may at times require
maintenance in addition to normal scheduled maintenance. Copier1 will
pursue all reasonable efforts under the terms of this agreement to as
described herein. Customer agrees
to treat Copier1 staff in a polite and respectful manner or
warranty coverage will be voided.
13.
Differences in speed or model number throughout a manufacturer's model
series and variations in equipment history including meter counts may
will inevitably vary throughout Copier1's supplied products and should
not be considered absolute and modifications to hardware and software
which may or may not have occurred and may alter such digital records
should not be assumed to be accurate cannot be guaranteed by Copier1.
Stated or digital history are not a basis for equipment valuation
under the terms of this agreement, not shall such information be
considered in any way to affect related or unrelated clauses of this
entire agreement. Valuation of equipment shall be determined solely by
the negotiated full delivered price as invoiced and not by the year of
manufacture, copy count, digital or printed maintenance history, and/or in-service dates, which also may vary throughout
equipment and are not guaranteed. Copier1 has developed systems to
ensure consistent product throughout a model range, and among varying usage history,
and adherence to the terms of this Agreement shall not be based upon
these factors.
14.
Vendor will assist in repairing shipping damage or replacing equipment
with similar equipment at the customers expense. Shipping claims
are the sole responsibility of customer, although vendor will assist in
filing shipping claims by providing any necessary documentation
available to vendor. Customer should retain all packaging materials.
Such claims are not to be used in lieu of payment and customer hereby
agrees that payment will not be withheld, rescinded or denied by any other means as the result of such shipping or
warranty claims.
15. Special provisions
for export sales. All sales shipped to locations outside of the
continental United States, or packaged for shipment to outside the
United States, or on any equipment later moved to a location outside the
United States are as-as and have no warranty coverage. Equipment sold by Copier1 and its affiliates for
use in 220 volts electrical systems, or any other non- U.S. power
systems are not covered under any warranty and customer agrees to
indemnify Copier1 and its affiliates from any damages arising from the
use of said equipment. This includes export wholesale
transactions, or bulk, or container sales. All such sales are deemed
final and all equipment is sold on an "as-is, where-is" basis
with no warranty whatsoever, whether implied, stated, or printed.
16. Maintenance
Agreements. Maintenance agreements are separate contracts, and may
provide additional, ongoing parts and/or labor coverage. Outsourced
nationwide coverage ordered by Copier1 or customer is the responsibility
of the customer. Copier1
does not cover any costs to replace parts deemed necessary by outside
maintenance provider to make equipment eligible for that company's
maintenance agreement. Third party vendors may require additional parts
and labor be purchased by customer prior to the offering of a
maintenance contract by said third party vendor, or the third party
vendor may deny the product for such an agreement. This is outside the
control of Copier1 and is not a basis for any withholding of payment by
customer and in no way alters the terms of this agreement.
17. Customer agrees to
purchase all supplies from Copier1 at competitive rates or all
warranties become void.
18.
Credit card cancellation fee
of 25% will apply in addition to finance charges on any unpaid balances.
Breach of contract penalty of 25%. Stop payment for any check written
for delivered equipment will be subject to a $300 fee, which customer
agrees to pay in addition to all bank fees. Customer also agrees to be held
responsible for all costs of collection including any attorneys' fees,
and that any legal actions pertaining to sale will take place in
Wicomico County, Maryland, USA. Customer also agrees to enter into binding arbitration
in Wicomico County, Maryland, USA prior to any civil litigation whenever a dispute may arise over the
terms of this transaction and/or agreement. Customer agrees to entertain
all efforts at informal and/or legal mediation by and between customer and Copier1 prior to
filing any such civil or third party complaints mediation services, such
as BBB, or
customer's warranty will be completely void.
19. Where disputes cannot be
resolved through agreed-upon terms between Customer and Copier1, LLC,
all legal proceedings are to occur in Wicomico County, Maryland.
Customer agrees to submit to binding arbitration where available, and
to pay all of Copier1's legal fees where the ruling of the arbiter is
declined, and/or when any legal proceedings are filed by or for
customer against Copier1
outside of Wicomico County, Maryland.
20. Commercial Production Application. Because of
heavy usage in production and commercial environments, machines used
for production of printed documents for resale or contracted scanning
services, including those provided by print and/or copy shops,
are ineligible for warranty coverage under this Agreement. Separate
Maintenance Agreements must be purchased for ongoing coverage when
equipment is used in this manner.
21. Unpaid invoices for products and services
delivered by Copier1 or one of its contractors will be charged a
finance charge of one-half percent per month on the out standing
balance.
Copier1 is dedicated to
making your experience with us a positive one and therefore we stand
behind everything we sell. No returns will be accepted
without an approved RMA number. Please contact 1-888-866-2679 with
specific questions. All copiers sometimes require maintenance and/or
adjustments to remain operable, this is more likely within the first
days of installation. Returned machines are subject to a 20% restocking
fee and all shipping charges both to and from customer location, and any
services provided are to be borne by customer. Pictures shown may not be
an exact representation of actual product. Some copiers are
manufacturers' equivalent virtually identical models.
Our copiers are used products
unless otherwise stated and noted. Copiers have been diagnostically tested and certified as working. Unless
otherwise stated, our products will come with pdf/cd or paper manuals, cables, software,
and drivers, or these items will be made available. Used items may have
slight cosmetic imperfections including minor scrapes or scratches;
slight casing discoloration; or dents. Copier1 cleans every item, and
repaints or replaces significantly scratched or discolored exteriors.
All sales are considered final and are nonrefundable unless
circumstances call for a refund based only upon the constraints of the
Warranty and Purchaser agreement, and this is the only agreement between
customer and Copier1.
THIS
WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER
RIGHTS WHICH VARY FROM STATE TO STATE (OR JURISDICTION TO JURISDICTION).
COPIER1'S RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN HARDWARE IS
LIMITED TO REPLACEMENT AS SET FORTH IN THIS WARRANTY STATEMENT. FOR
NON-UNITED STATES CUSTOMERS OR SHIPPING ADDRESSES, COPIER1 DISCLAIMS ALL WARRANTIES AND
CONDITIONS, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, FOR THE PRODUCT.
FOR U.S. CUSTOMERS, ALL EXPRESS AND IMPLIED WARRANTIES FOR THE PRODUCT,
INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES AND CONDITIONS OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN TIME
TO THE TERM OF THIS LIMITED WARRANTY. NO WARRANTIES, WHETHER EXPRESS OR
IMPLIED, WILL APPLY AFTER THE LIMITED WARRANTY PERIOD HAS EXPIRED. SOME
STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN IMPLIED
WARRANTIES OR CONDITIONS, OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY
OR CONDITION LASTS, SO THIS LIMITATION MAY NOT APPLY TO YOU. THIS
WARRANTY COVERAGE TERMINATES IF YOU SELL OR OTHERWISE TRANSFER THIS
PRODUCT TO ANOTHER PARTY UNLESS TRANSFER OF WARRANTY IS AGREED TO IN
ADVANCE BY COPIER MANAGEMENT.
WARRANTY MAY BE AMENDED OR UPDATED FROM TIME TO
TIME WITHOUT NOTICE AND ANY MODIFICATIONS ARE TO BE BINDING AND
RETROACTIVE.
COPIER1
DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES PROVIDED FOR IN THIS
LIMITED WARRANTY OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL
DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LIABILITY FOR THIRD-PARTY
CLAIMS AGAINST YOU FOR DAMAGES, FOR PRODUCTS NOT BEING AVAILABLE FOR
USE, OR FOR LOST DATA OR LOST SOFTWARE. COPIER1'S LIABILITY WILL BE NO
MORE THAN THE AMOUNT YOU PAID FOR THE PRODUCT THAT IS THE SUBJECT OF A
CLAIM. THIS IS THE MAXIMUM AMOUNT FOR WHICH COPIER1 IS RESPONSIBLE.
SOME
STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF
SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE
LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
By purchasing a copier from Copier
Discount Warehouse, Copier1, LLC, or through Copier1.com or any of it's
agents, employees, or affiliates, customer agrees to all above terms
and conditions.
